Member Terms of Use

1. Who we are and what this is

DUAL Perks (“PERKS”, “the app”) is a loyalty and discounts service operated by DUAL Ltd (“we”, “us”, “our”), St Andrews, Fife, Scotland.

These Member Terms of Use (“Terms”) are the agreement between you and us when you use PERKS as a member. Please read them alongside our Privacy Policy and Cookie Policy.

PERKS is free for members. You will never be charged by us for holding a card or using a discount.

2. How you get a PERKS account

You can become a member in one of two ways:

(a) You sign up yourself. You create an account in the app or on the web, choose a 4-digit PIN, and join an organisation’s programme.

(b) Your organisation enrols you. Your gym, club, hotel, village, or other organisation creates your membership and sends you a card, a wallet pass, or a link. This may be done by a system your organisation uses on its behalf.

Either way, these Terms apply to your use of PERKS. If your organisation enrolled you, we will ask you to accept these Terms the first time you open the app, the web card, or the member portal. Your organisation is responsible for having a proper basis to enrol you and for telling you what it does with your information — see section 9.

If you do not agree to these Terms, do not use PERKS, and you can ask us to close your membership at any time (section 11).

You must be at least 18 years old to hold a PERKS account. PERKS is not available to under-18s, and your organisation should not enrol you if you are under 18.

3. Your card, your PIN, your responsibility

Your membership is personal to you. You agree to:

Your PIN is a 4-digit code — it is convenient rather than highly secure, so please do not reuse a PIN you use for anything sensitive, such as a bank card.

If someone else uses your card, the discount may be refused and we may suspend your membership.

4. Offers come from partners, not from us

Every discount, perk, and reward on PERKS is offered and provided by an independent partner business. We do not provide, fund, price, or guarantee any offer.

This means:

If a partner refuses to honour a valid offer, please tell us at [support@dualperks.com] — we will raise it with them, but we cannot compel them to honour it and we cannot compensate you for it.

Nothing in this section affects your legal rights against a partner as a consumer.

If you break these Terms, we may suspend or close your membership. Where it is fair to do so, we will tell you why and give you a chance to respond.

7. AI-assisted features

Some parts of PERKS use an AI assistant to answer questions and help you find offers. When you use those features, the messages you send are processed by our AI provider (Anthropic PBC) on our behalf so we can generate a reply.

Please do not enter health information, financial details, or other sensitive personal information into chat features. AI-generated answers can be wrong — check anything important against the offer’s own terms.

8. Your organisation’s programme

Your access to PERKS depends on your membership of an organisation’s programme.

We will give reasonable notice before a programme is withdrawn where we are able to.

We work to keep PERKS running, but we provide it “as is” and “as available”. We do not promise that it will always be uninterrupted or error-free, and we may need to carry out maintenance or updates that affect availability. PERKS relies on third-party infrastructure, and outages there may affect it.

11. Ending your membership

You can leave at any time. Ask your organisation’s administrator to remove you, or email us at privacy@dualcreative.com and we will close your membership and delete your personal data in accordance with our Privacy Policy (retained for 30 days, then permanently deleted; backups purged within 90 days).

We may end or suspend your membership if you break these Terms, if we are required to by law, or if we discontinue PERKS (with reasonable notice).

When your membership ends, your access to offers and any unredeemed stamps ends with it.

12. Our responsibility to you

We are responsible to you for foreseeable loss and damage caused by us breaking these Terms or failing to use reasonable care and skill. We are not responsible for loss or damage that is not foreseeable, or that is caused by a partner, by your organisation, or by your own breach of these Terms.

We do not exclude or limit our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be excluded or limited.

Nothing in these Terms affects your statutory rights as a consumer. If you are a consumer, you have legal rights that cannot be taken away by contract, and these Terms are to be read subject to those rights.

Because PERKS is free to you, and because we do not provide the offers themselves, our liability to you in connection with PERKS is limited to £100 — except where section 12 says liability is not limited.

13. Changes to these Terms

We may update these Terms. If a change is material, we will tell you in the app or by email at least 14 days before it takes effect. If you do not agree to the change, you can close your membership under section 11. Continuing to use PERKS after the change takes effect means you accept it.

14. Law and complaints

These Terms are governed by the law of Scotland, and you can bring proceedings in the Scottish courts. If you live elsewhere in the UK or in the EU, you keep the benefit of any mandatory consumer protections of your home country and may bring proceedings there.
